Scope and Applicability
These Terms and Conditions ("Terms") govern all purchases made through the Comely online store operated by Shuguang Handel GmbH ("we", "us", "our"), accessible at www.comely.com.
By placing an order, you confirm that you have read, understood, and agreed to these Terms. These Terms apply exclusively to consumers as defined under EU consumer protection law — that is, individuals acting for purposes outside their trade, business, craft, or profession.
We reserve the right to update these Terms at any time. The version applicable to your order is the one published on this page at the time of purchase.
Products and Availability
All products listed on our website are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions at any time without prior notice.
We make every effort to display product images, colours, and specifications as accurately as possible. However, slight variations may exist due to screen settings, photography, or product improvements. Such variations do not constitute a defect.
All Comely products are CE marked and EU RoHS compliant and are designed for use within the European Union.
Prices and Taxes
All prices shown on our website are in Euros (EUR) and include VAT where applicable, unless otherwise stated. Shipping costs are not included in the displayed product price and are calculated separately at checkout.
We reserve the right to change prices at any time. The price applicable to your order is the one confirmed at the time of checkout. In the event of a pricing error, we will contact you before processing your order.
Payment
Payment is due at the time of placing your order. We accept the following payment methods through Shopify Payments:
- Visa, Mastercard, American Express and other major credit and debit cards
- PayPal
- Klarna (buy now, pay later, subject to Klarna's own terms)
- Apple Pay and Google Pay
- All other payment methods available through Shopify Payments
All transactions are processed securely via SSL encryption. We do not store your payment details on our servers. Shopify Payments is PCI DSS compliant.
Your order will only be confirmed and processed upon successful authorisation of payment.
Order Confirmation and Contract Formation
After placing your order, you will receive an automated order confirmation email. This email is an acknowledgement of receipt and does not constitute acceptance of your order.
A binding purchase contract is formed when we send you a dispatch confirmation email confirming that your order has been shipped. We reserve the right to decline any order prior to dispatch — for example, if a product is out of stock or a pricing error has occurred. In such cases, you will be notified and any payment taken will be refunded in full.
Shipping and Delivery
We ship to all European Union member states. Orders are dispatched within 1–2 business days of purchase. Estimated delivery time is 48–72 hours from dispatch, depending on the destination country and carrier.
Shipping is free on all orders over €60. For orders below €60, a flat fee of €5.90 applies, regardless of destination within the EU.
Delivery times are estimates and not guaranteed. We are not liable for delays caused by the carrier, customs, or circumstances beyond our control. Risk of loss passes to you upon delivery to the address provided at checkout.
If a delivery attempt fails and the package is returned to us, we will contact you to arrange redelivery. Additional shipping costs may apply.
Right of Withdrawal
As a consumer in the European Union, you have the right to withdraw from your purchase without providing any reason within 14 days of the day you receive your order (the "withdrawal period").
To exercise your right of withdrawal, you must inform us of your decision before the withdrawal period expires. You can do so by contacting us at info@comelylight.com with your name, order number, and a clear statement of your intention to withdraw.
You must return the goods to us without undue delay and no later than 14 days after notifying us of your withdrawal. The direct cost of returning the goods is your responsibility, unless the item was received in a faulty or incorrect condition.
Products must be returned in their original condition and packaging, unused and undamaged. We reserve the right to deduct from the refund an amount corresponding to any diminished value of the goods resulting from handling beyond what is necessary to assess the nature and functioning of the product.
We will process your refund to your original payment method within 14 days of receiving the returned goods (or of receiving proof that the goods have been returned, if earlier). We may withhold the refund until we have received the goods back.
Warranty and Statutory Rights
All Comely products are covered by a 2-year commercial warranty from the date of purchase, covering manufacturing defects and hardware failures under normal use conditions. This warranty does not cover damage caused by misuse, unauthorised modifications, accidents, or normal wear and tear.
In addition to our commercial warranty, your statutory rights as a consumer under EU law remain fully unaffected. Under EU Directive 2019/771, you are entitled to a 2-year statutory guarantee covering goods that do not conform to the contract of sale.

Liability
We are liable without limitation for damages resulting from injury to life, body, or health caused by our negligence or intent, and for damages caused by our wilful misconduct or gross negligence.
For ordinary (non-gross) negligence, our liability is limited to damages arising from the breach of a material contractual obligation (i.e. an obligation whose fulfilment is essential to the proper performance of the contract and on which you may regularly rely). In such cases, liability is limited to foreseeable, typically occurring damages.
Liability for indirect damages, loss of profit, or consequential loss is excluded to the extent permitted by applicable law.
Intellectual Property
All content published on the Comely website — including but not limited to product images, texts, logos, designs, and graphics — is the property of Shuguang Handel GmbH or its licensors and is protected by applicable copyright and intellectual property laws.
You may not reproduce, distribute, or use any content from this website for commercial purposes without our prior written consent.
Data Protection
The processing of your personal data in connection with your purchase and use of our website is governed by our Privacy Policy, which is incorporated into these Terms by reference. By placing an order, you acknowledge that you have read our Privacy Policy.
Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This does not affect any mandatory consumer protection rights you are entitled to under the laws of your country of residence within the EU.
The place of jurisdiction for all disputes arising from these Terms, to the extent permitted by law, is Germany.
Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR) for consumers, accessible at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by law.

Severability
